1. About LINEUP
LINEUP (“we”, “us”, “the Platform”) is an online marketplace that connects surfboard owners (“Owners”) with people who want to rent surfboards (“Renters”). LINEUP is operated as a sole proprietorship in Portugal for the MVP phase.
2. Role as Intermediary
LINEUP acts solely as an intermediary platform. We facilitate connections between Owners and Renters but are not a party to the rental agreement between them. LINEUP does not own, inspect, or guarantee the condition of any surfboards listed on the platform.
By using LINEUP you acknowledge that the rental contract exists exclusively between the Owner and the Renter and that LINEUP bears no liability for the condition of equipment, injuries arising from its use, or disputes between the parties except as expressly stated in these Terms.
3. Account Registration
- You must be at least 18 years old to create an account.
- You agree to provide accurate, current information during registration.
- You are responsible for maintaining the confidentiality of your credentials.
- By creating an account you accept these Terms and our Privacy Policy.
4. Bookings & Payments
All payments are processed securely through Stripe. LINEUP never stores your full card details.
- Rental payment: The total rental amount (board fee + service fee) is charged when the Owner confirms the booking.
- Service fee: LINEUP charges a 15% service fee to the Renter (the person reserving the board) on top of the rental price. We currently charge a 0% platform fee to the Owner. Fee percentages may change in the future with 30 days’ notice.
- Payouts: Owner payouts are processed via Stripe Connect and transferred to the Owner’s connected bank account after the rental period ends without dispute.
5. Security Deposit & Damage Liability
A security deposit (the amount shown on each listing) is authorised on the Renter’s payment method at pick-up. This is a temporary hold, not a charge.
- If the board is returned in the same condition, the hold is automatically released within 5–7 business days.
- If the Owner reports damage within 24 hours of the return, the Owner may submit a damage claim through the platform with photographic evidence. LINEUP will review the claim and, if valid, capture part or all of the deposit to compensate the Owner.
- If damage exceeds the deposit amount, the Renter is legally obligated to compensate the Owner for the difference. LINEUP will facilitate communication, but cannot automatically charge more than the authorized deposit.
- Renters may dispute a claim within 48 hours. LINEUP will mediate in good faith.
- Both parties agree to the mandatory Handover Protocol. The Renter must upload photographic evidence of the board’s condition at pick-up and drop-off. Failure to provide check-in photos assumes the board was received in perfect condition.
6. Cancellation Policy
- Renter cancellation: Free cancellation up to 48 hours before the rental start date. Cancellations within 48 hours may incur a fee equal to 50 % of the first day’s rental.
- Owner cancellation: Owners may cancel at any time. Repeated cancellations may result in reduced listing visibility or account suspension.
7. Prohibited Conduct
You agree not to:
- List equipment you do not own or have the right to rent.
- Misrepresent the condition of a surfboard.
- Circumvent the platform to avoid service fees.
- Harass, threaten, or abuse other users.
- Upload fraudulent identity documents.
8. Limitation of Liability
To the maximum extent permitted by Portuguese and EU law, LINEUP shall not be liable for indirect, incidental, or consequential damages, including personal injury, arising from the use of equipment rented through the platform. LINEUP’s total liability shall not exceed the service fees earned on the relevant booking.
9. Intellectual Property
All content, logos, and trademarks on LINEUP are owned by LINEUP or its licensors. User-submitted photos remain the property of the uploader but are licensed to LINEUP for display on the platform.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of Portugal. Any dispute arising from the use of the platform shall first be submitted to mediation through a Portuguese Consumer Dispute Resolution Centre (Centro de Arbitragem de Conflitos de Consumo). If mediation fails, disputes shall be resolved in the courts of Lisbon. EU consumers may also use the EU Online Dispute Resolution platform.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the new Terms take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.
